Terms of Use

These Terms of Use govern access to and use of the volade.com website, the Volade products (browser, extensions, CMS plugins, desktop software, mobile apps, scripts and web tools) and the related premium services. They apply to any use, whether you are a consumer or a business.

1. Purpose

These Terms define the conditions under which Volade makes its products and services available, and the rights and obligations of each user. They are supplemented by the Terms of Sale, the Privacy Policy and the Cookie Policy.

2. Definitions

• "Volade ecosystem": all products published by Volade (browser, CMS, desktop, mobile, scripts, API, web tools).
• "Account": the personal space created by the user on volade.com.
• "Premium licence": the right of use granted to the user after subscription.
• "User": any person accessing the website or the products, whether a consumer or a business.

3. Acceptance of the Terms

By accessing the website, installing a product, creating an account or subscribing, you accept these Terms without reservation. If you do not accept them, you must refrain from using our services. Acceptance is evidenced by a checkbox at the time of purchase, kept as proof.

4. User account

• Creating an account is required to access premium services.
• You must have the necessary legal capacity (adults; minors only with parental consent).
• You agree to provide accurate, current and complete information.
• You are responsible for the confidentiality of your credentials and for any activity carried out from your account. Any abnormal use must be reported immediately to contact@volade.com.
• An account is personal: creating accounts to circumvent licences, to share for payment or to resell is prohibited.

5. End-user licence

Volade grants you a personal, non-exclusive, non-transferable and revocable right to use the products, for the duration of your subscription and limited to the number of devices authorised by your plan. This licence does not transfer any ownership right in the software, which remains the exclusive property of Volade.

The products are provided "as is" within the limits permitted by law, together with the legal guarantees applicable to consumers (in particular Articles L.217-3 et seq. of the French Consumer Code).

6. Premium subscription and pricing

• The subscription is offered on monthly, annual and, where applicable, lifetime plans.
• One premium licence covers all Volade products (browser, CMS, desktop, mobile, scripts) on the devices connected to your account.
• Payment is handled securely via Stripe.
• Prices are shown in euros (or local currency), VAT included for consumers, before application of any discount code.
• The subscription renews by tacit renewal at the end of the period, unless cancelled before the end of the current period.
• You can cancel at any time from your account; the service remains active until the end of the paid period. An online cancellation feature is available, in accordance with Article L.215-1-1 of the French Consumer Code.
• Volade may change its prices, subject to prior notice and, for consumers, the possibility of cancelling without charge.

7. Promo codes and welcome discount

Promo codes (e.g. WELCOME) are strictly personal, non-cumulative unless stated otherwise, valid under the conditions indicated when granted, and neither exchangeable nor refundable. Any abusive or systematic use (multiple accounts, circumvention) may result in the cancellation of the discount and the suspension of the account.

8. Withdrawal right

As a consumer, you have 14 days from the subscription to exercise your withdrawal right (Articles L.221-18 et seq. of the French Consumer Code). This right is lost for digital content supplied immediately and with your express consent and waiver of the withdrawal right, as provided in Article L.221-28 of the same code.

In addition, Volade offers a 30-day "satisfied or refunded" commercial guarantee for premium subscriptions, which adds to your legal rights. Details in the Terms of Sale.

9. Fair use

The premium licence is intended for personal and reasonable use. The following are notably considered abusive: mass sharing of a licence, unauthorised resale, circumvention of licence mechanisms, competitive use of the products, renting or lending the account. Such uses may result in the suspension or termination of the account without refund.

10. User obligations

You are prohibited from, in particular:

• reproducing, modifying, adapting, distributing, renting or reselling the products without written authorisation;
• circumventing technical protections (DRM, licence checks);
• reverse engineering, decompiling or disassembling the software (except where permitted by law);
• using the service for illegal, fraudulent, defamatory or harmful purposes;
• harming the security, integrity or availability of Volade servers;
• collecting data from other users without authorisation.

11. Intellectual property

The Volade ecosystem and all its elements (source code, interfaces, trademarks, logos, content, documentation) remain the exclusive property of Volade, protected by the French Intellectual Property Code. The granted licence does not transfer or assign any rights. Any infringement exposes its author to the penalties of Articles L.335-2 et seq. of the French Intellectual Property Code.

12. Liability

Within the limits permitted by law, Volade shall not be liable for indirect or immaterial damages (data loss, loss of profit, business harm) resulting from the use of the products. Volade makes its best efforts to ensure the availability and security of the service, without a guarantee of continuous availability (maintenance, technical events, force majeure).

For consumers, these provisions do not deprive the user of mandatory legal guarantees, in particular the legal conformity guarantee (Articles L.217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Article 1641 of the French Civil Code).

13. Suspension and termination

In the event of a serious or repeated breach of these Terms, Volade may suspend or terminate access to the account, after written notice where reasonably possible. Termination for breach does not entitle to any refund of the current period, except where provided by law. The user may delete his or her account at any time from the personal space.

14. Personal data

The processing of your data is described in the Privacy Policy, compliant with the GDPR. The use of cookies is described in the Cookie Policy.

15. Force majeure

Volade's liability shall not be incurred for the non-performance of its obligations resulting from a case of force majeure as defined by Article 1218 of the French Civil Code and applicable case law.

16. Applicable law and disputes

These Terms are subject to French law. As a consumer, you benefit from the mandatory protection of the law of your country of residence. In the event of a dispute, an amicable solution will be sought in priority; failing that, you may have recourse, free of charge, to the consumer mediator CM2C (49 rue de Ponthieu, 75008 Paris, tel. 01 89 47 00 14, www.cm2c.net) or to the EU ODR platform. In the absence of agreement, the French courts have jurisdiction under common-law rules.

17. Changes to these Terms

Volade may amend these Terms (new features, legal requirements). The applicable versions are those in force at the time the service is used. Substantial changes may be notified by email in order to obtain your agreement where the law so requires.
